Emergency Custody Lawyer in Philadelphia

Protecting Children When a Standard Hearing Date Can’t Wait

When a child’s safety is at immediate risk, Philadelphia’s Family Court has a process to intervene quickly. But getting there requires precise, same-day filings and procedural steps that leave little margin for error. Law Office of Smith & Horwitz focuses exclusively on family law and has handled family litigation in Philadelphia for over 35 years, giving our attorneys the procedural familiarity these situations demand.

If you believe your child is in immediate danger, don’t wait for a routine hearing date. Call our Philadelphia emergency custody attorneys now at (215) 515-8464 or contact us through the form on this site to discuss your situation.

What Qualifies as an Emergency Custody Situation

An emergency custody order is a short-term, court-granted arrangement designed to protect a child facing immediate danger. Philadelphia courts interpret the emergency standard narrowly. A general concern about the other parent’s parenting isn’t enough. The threat must be real, present, and serious.

Situations that may support an emergency petition include:

  • Immediate physical danger to the child
  • A parent being charged with a violent crime
  • Imminent removal of the child from Pennsylvania’s jurisdiction

When evaluating these petitions, the court applies the best interest of the child standard with particular weight given to safety factors: any history of abuse, active Protection from Abuse orders, violent or assaultive behavior, or drug or alcohol abuse in a party’s household.

Philadelphia’s Emergency Custody Filing Process

Philadelphia Family Court requires a prerequisite filing before you can submit a Petition for Emergency Relief. You must already have one of the following pending: a Complaint for Custody, a Petition to Modify Custody, or a Petition for Contempt. If none of these is on file, it must be filed at the same time as the emergency petition.

The Hearing Officer & Emergency Judge

On the day of filing, a hearing officer conducts a preliminary assessment to determine whether the situation may qualify as an emergency. The petitioner then decides whether to proceed. If the case moves forward, it is docketed and reviewed by a designated Emergency Judge, who rules on whether emergency custody may be granted.

If the court grants emergency custody, a follow-up hearing may be scheduled so both parties can present testimony and evidence. Filing fees in Philadelphia total $107.13 for the standard custody filing, plus an additional $42.68 for the emergency petition itself.

Jurisdictional Requirements

Pennsylvania generally requires that a child have lived in the state for at least six months before a court will establish jurisdiction over a custody matter. Exceptions exist for children under six months old and for certain emergencies such as abandonment or abuse. Whether your situation qualifies for an exception is a court determination, and we can help you assess how that rule applies to your circumstances.

Emergency vs. Expedited Custody Petitions in Philadelphia

Not every urgent custody matter rises to the level of a same-day emergency. Philadelphia also offers an Expedited Petition for situations requiring prompt court attention that don’t meet the strict emergency threshold.

Qualifying situations for an expedited petition include:

  • A parent being charged with a crime posing risk to the child
  • The child needing urgent medical or educational attention
  • Being denied access to the child
  • The other party unilaterally changing custody terms

Expedited petitions may only be filed on Wednesdays, or on Thursday when the court is closed on Wednesday. Like emergency petitions, they require a Complaint for Custody, Petition to Modify, or Petition for Contempt to be already on file or filed simultaneously. Choosing the wrong track can cost critical time, and we can review your situation to tell you which path may fit.
